• Yellow Lemon Software will throughout this License Agreement be referred to as both "YLS" and "Yellow Lemon Software".
• A "registered user" is a person who has paid for any software title ("product") created or distributed by Yellow Lemon Software. The "registered user" is only defined as a registered user of the product he or she has paid for.
• A "user" is a person who is actively using any software title created or distributed by Yellow Lemon Software.
• A "local copy" is a copy of any product ("software title") created or distributed by Yellow Lemon Software, kept on a hard drive, floppy disk or other writeable media.
• A "registration fee" is the amount of money paid by any user for any of Yellow Lemon Software's products. This term covers user, site and world licenses.
• A "registree" is a user who has registered any Yellow Lemon Software product (see "registered user").
• A "software bug" or "bug" is an unknown problem with the software title's code, and is not intended to be a part of the product.
• A "registration code" is a set of numbers or characters used to remove any shareware notices used in the program or enable specific features of the program.
ii. License for Memory Measure
Yellow Lemon Software grants a free, 30-day license for use of the above said product. This free license expires 30 days after the time of original receipt of this software, after which Yellow Lemon Software must be given proper compensation for the software. Pricing and information about registering should be included with this file. The software may, under no circumstances, be used beyond the 30-day free license, unless the above conditions have been satisfied.
By using the above mentioned product, the user has agreed to this license in its entirety. If any part of this license has been modified by anyone else than Yellow Lemon Software itself or its associates, the original license will apply.
The user is encouraged to contact Yellow Lemon Software if he or she would like to have an original copy of the license sent to him or her.
If the user decides to decline any part of this license aggreement, or the user breaks any part of this license aggreement, the license will be withdrawn and effectively terminated.
iii. Warranties
Yellow Lemon Software provides no warranty whatsoever with any of its products. All products are provided as-is, and are not guaranteed to be bug free. Yellow Lemon Software will not be held liable for any damage caused to your computer, equipment, data or otherwise through the use or inability to use any of YLS' products. This includes damages for loss of business profits, loss of business information, business interruption, and the like.
Yellow Lemon Software does not warrant that the functions of this software will meet your requirements or that the software will operate error-free or uninterupted. Yellow Lemon Software has used reasonable efforts to minimize defects or errors in the software. You assume the risk of any and all damage or loss from the use or inablility to use the software.
iv. User technical support
Yellow Lemon Software currently provides free technical support to all of its users, registered or otherwise. Questions, comments or bugs can be sent to yls@kagi.com. YLS will try to provide you with an answer to your inquiry as soon as possible, however, YLS does not provide any answering guarantee. If you do not get a reply to your inquiry within a week, you are advised to check out the Yellow Lemon Software homepage, located at <http://home.sol.no/~stoedle/YLS/> for any latebreaking news that might explain the lack of response.
v. Registration fee refunds
Refunds will not be issued for products that fail to work*, have bugs and/or does not provide satisfaction due to other circumstances than the pure functional purpose of the product. Refunds will not be issued after more than 30 days of purchase under any circumstances.
* This includes problems due to revisions of the MacOS operating system, extension conflicts, lack of RAM, VRAM, hardware or other software related problems.
If the registered user's reason for demanding a refund is due to a significant error with the product or its documentation, Yellow Lemon Software will at its option 1) correct demonstrable and significant program or documentation errors within a reasonable period of time; or 2) provide the registered user with a refund (and thus terminating the license).
In the case of a refund, the user will no longer be considered a registered user and will be asked to terminate any local copies of the product for which he or she is getting a refund. The user will also be asked to destroy any copies of the registration code (if applicable).
vi. Termination
Yellow Lemon Software reserves the right to terminate any user, site or world licenses issued by returning the registration fee to the registree. The registree will be asked to terminate any local copies of the software product for which the license is withdrawn.
vii. Distribution
For-profit distribution of any product made or distributed by Yellow Lemon Software is strictly prohibited unless the distributor has the written consent (via e-mail or otherwise) of Yellow Lemon Software. Non-profit distribution is granted to anyone without prior notice, provided the software, its documentation and this license agreement is included without modification in any way. All non-profit distributors are encouraged to notify Yellow Lemon Software before distributing, to prevent any legal disputes.
viii. Changes to the software
Yellow Lemon Software reserves the right to change any aspect of the above mentioned software without notice, including, but not limited to, change in file formats, implementation of program and graphics.
ix. Reverse engineering
Reverse engineering of the above mentioned software is strictly prohibited. Copying any of the program's resources or code is also prohibited, unless the written consent of the author is provided.
x. Registration codes
Registration codes are provided with some programs, and may or may not be relevant to the above mentioned software. Upon registration, the user will receive a code which can be used to remove any shareware notices or fully enable the software in question. The registration code will be provided to the user within reasonable time and the user is not allowed to transfer this code to anyone else.
xi. Copyright
Yellow Lemon Software holds the copyright to the above mentioned software, including but not limited to graphics, sounds, text or code, as well as any documentation distributed with it. No part of the software can be copied without the consent of the author, with the exception of screenshots and quotations from the documentation*.
* These quotations must not be taken out of context. Copying graphics from a screenshot is not allowed.
